notween — terms of service

These terms are the agreement between you and Tule Fog Games, LLC, of Davis, California ("we") about using notween. notween is offered in the United States and India. By using notween you agree to them. Please also read our Privacy Policy.

1. You must be 18 or over

notween is only for adults. We ask your date of birth when the app first opens. If you are under 18, you may not use notween. Don't give a false date of birth.

2. Your access

notween gives your phone a random key; there is no password or account yet. If you delete the app or its data, we can't give you back what was tied to that key. Don't share the key, and don't try to use anyone else's.

You can delete your account in the app's settings (or, without the app, by email as described at tulefoggames.com/notween/delete). What you posted is hidden at once; after 30 days your information is erased, and each post stays only as an empty placeholder so the remixes other people made of it still make sense. Until then you can cancel.

3. How notween works

• You type an idea (a "prompt") and notween makes a short animated scene from it using artificial intelligence (Claude, by Anthropic).
• Scenes are made by a machine. They may be odd, wrong, or not what you meant. We may refuse to make or post a scene.
• There is a daily limit on how many scenes you can make. We set the limit, it may differ from country to country, and we may change it.
• You can post a scene. Once posted, it is public: anyone on notween can watch it, and anyone with its link can watch it without the app.
• Other people can remix your post: make a new scene that starts from yours. The remix shows it came from yours.

4. What you may not make or post

You may not use notween to make, post or send anything that:

• is sexual, pornographic, or sexualises anyone;
• mocks or attacks people for their race, ethnicity, religion, disability, sex, gender, sexual orientation or similar traits, or uses those traits as the joke;
• threatens, harasses or bullies anyone, or targets a real private person;
• shows or encourages serious violence, self-harm, or illegal acts;
• pretends to be someone else, or misleads people about who made something;
• copies someone else's work (for example characters, logos or music) in a way you have no right to;
• spams, or tries to trick people into doing something.

We check prompts before a scene is made, and scenes and comments before they are posted, using automated tools. We refuse what breaks these rules. We may also hide or remove anything later, and limit or stop anyone's use of notween, if we believe they broke these terms.

You also may not:

• use bots or scripts to make, copy or collect scenes;
• get around the daily limit or the device checks;
• interfere with notween's servers;
• try to find out who is behind a made-up name.

5. What you post, and what you let us do with it

• Yours: as between you and us, you keep whatever rights you have in your prompts, comments and the scenes made for you. Whether an AI-made scene can be owned by anyone is not settled law, and we don't promise that it can.
• What you let us do: you give us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, show, adapt and distribute what you post. We use it to run, show and promote notween. This licence lasts as long as your post is part of notween, because remixes depend on it: a post can be removed from view, but the chain of remixes built on it stays.
• What you let other people do: by posting, you let other people on notween watch, share and remix your post inside notween, and let their remixes show that they came from yours.
• Removing: you can remove your own post or comment at any time. It is then hidden from everyone. Remixes already made from it stay, marked as coming from a removed post.
• You promise you have the right to post what you post, and that it doesn't break these terms.

6. Reporting and takedown

• In the app: report any post, comment or person you think breaks these terms. When 3 different people report the same post or comment, it is hidden automatically while we look at it. We review reports, and we may dismiss a report, hide a post or comment, or ban the person behind it.
• Blocking: you can block anyone. You then no longer see each other's posts, profiles, comments or activity in the app, and neither of you can follow the other or send a friend request. They are not told.
• Copyright: if you believe something on notween copies your work, send a notice to our designated agent: Aneesh Panoli, Tule Fog Games, LLC, Davis, California, admin@tulefoggames.com. The notice must include:
  • who you are;
  • what the work is;
  • where on notween the copy is (the link);
  • a statement that you believe in good faith the use is not authorised;
  • a statement, under penalty of perjury, that your notice is accurate and that you own the work or may act for the owner;
  • your signature.

  We remove what infringes. We stop people who repeatedly infringe.

• Grievance Officer (India): under India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you can send a complaint about content on notween, or about these terms, to our Grievance Officer: Aneesh Panoli, Tule Fog Games, LLC, Davis, California, admin@tulefoggames.com.
  • We acknowledge a complaint within 24 hours and resolve it within 15 days.
  • Content that shows a person's private areas, shows them in full or partial nudity or in a sexual act, or impersonates them in such content, is removed within 24 hours of a complaint about it.

7. Ads

• The Android and iOS apps show ads from Google AdMob between scenes in your feed, at most 4 an hour. Some fill the screen.
• An ad for one more scene: once you have used up the day's scenes, you can choose to watch a short ad for 1 more scene, up to 5 times a day. A day here is a UTC day. The extra scenes are for that day only.
• You get the scene only when Google confirms to our server that you watched the ad. If the ad doesn't finish, or isn't confirmed within 10 minutes, no scene is added.
• Extra scenes have no cash value. You can't sell, transfer or swap them for money, and they don't carry over to another day.
• We decide when an ad for a scene is offered and may change the number of ads, the number of extra scenes, or stop offering them.
• Don't use bots, scripts or anything else to fake watching ads or to collect extra scenes.
• What Google's ad software collects, and your choices about it, are in our Privacy Policy.

8. Friends and notifications

• A friendship on notween only exists when both people agree.
• Notifications are only about things that happened to you, and you can turn each kind off.

9. Changes and stopping

• We may change notween, or stop parts of it or all of it. We will tell you in the app before we make a change to these terms that matters, and using notween afterwards means you accept it.
• You can stop using notween at any time.

10. No guarantees

notween is provided "as is". We don't promise it will always work, be available, or keep your drafts. To the extent the law allows:

• we are not responsible for indirect or unexpected losses.

Nothing in these terms limits rights you have that the law says can't be limited.

11. The law that applies

These terms are governed by the laws of the State of California, USA, and disputes go to the courts of California, except where the law of the country you live in gives you the right to use your own courts and laws. If you are in India, this doesn't take away any rights the law of India gives you.
